Terms of Service

1. Agreement to Terms

By accessing or using the services of MubarakSol (Private) Limited ("Company," "we," "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services

We provide software development, web development, mobile app development, AI/ML solutions, UI/UX design, cyber security services, and related IT consulting. The specific scope of services will be defined in individual project agreements or statements of work.

3. Quotes and Proposals

All quotes are valid for 30 days from the date of issue
Quotes are based on information provided by the client
Any changes to scope may require revised pricing
Quotes do not constitute a binding contract until signed by both parties

4. Payment Terms

Standard Payment: 40% advance, 30% mid-milestone, 30% on delivery
Invoices are due within 7 days of issuance
Late payments may incur a 2% monthly fee
Work may be paused if payment is delayed beyond 15 days
Accepted payment methods: Bank transfer, Wise, PayPal (for international clients)

5. Client Responsibilities

Provide timely feedback and approvals
Supply required content, images, and assets
Respond to communications within 5 business days
Ensure all provided materials don't infringe on third-party rights
Provide necessary access to systems and tools

6. Intellectual Property

After full payment: Client owns the final deliverables
Before full payment: Company retains all rights
Company tools/libraries: Remain property of the Company
Third-party components: Subject to their respective licenses
Portfolio rights: We may showcase the project in our portfolio unless NDA prevents it

7. Revisions and Changes

Each package includes a specified number of revisions
Additional revisions are billed hourly
Significant scope changes require a new agreement
Revisions requested more than 30 days after project delivery are subject to additional charges

8. Project Timeline

Estimated timelines are provided in good faith but are not guaranteed. Delays caused by:

Late client feedback or approvals
Incomplete or delayed content/assets
Third-party service issues
Force majeure events

...will result in extended timelines.

9. Warranties and Support

We provide a 30-90 day bug-fix warranty depending on the package
Warranty covers defects in our code, not new features
Post-warranty support available via maintenance packages
We don't guarantee 100% bug-free software (industry standard)

10. Limitation of Liability

To the maximum extent permitted by law:

Our total liability is limited to the amount paid by the client for the specific project
We are not liable for indirect, incidental, or consequential damages
We are not responsible for lost profits, data loss, or business interruption
We are not liable for issues caused by third-party services or client negligence

11. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the engagement. This obligation survives termination of the agreement.

12. Termination

Either party may terminate with 15 days written notice
Client pays for work completed up to termination date
Advance payments are non-refundable if work has commenced
We reserve the right to terminate for non-payment or breach of terms

13. Refund Policy

Before work starts: 100% refund minus processing fees
After work starts: Pro-rated refund based on completed milestones
After delivery: No refunds (30-day bug-fix warranty applies)
Refunds processed within 10 business days

14. Governing Law

These Terms are governed by the laws of Pakistan. Any disputes will be resolved through arbitration in Dera Ghazi Khan, Punjab, Pakistan.

15. Changes to Terms

We may modify these Terms at any time. Continued use of our services after changes constitutes acceptance.
